Ministry of Social Affairs and Labor Issues Circular to Enforce Employment Quota for Persons with Disabilities

The Ministry of Social Affairs and Labor issued a ministerial circular today mandating the enforcement of employment quotas for persons with disabilities across government, public, mixed, and private sectors. This initiative comes as part of implementing the provisions of Law No. (61) of 1999 regarding the Care and Rehabilitation of Persons with Disabilities, aimed at fostering their integration into the labor market, empowering them to exercise their legal rights, and enabling their active participation in the development process.
The circular strictly requires government entities and public and mixed-sector units to allocate 5% of all vacant positions to qualified individuals with disabilities. Furthermore, it mandates that private sector employers employ at least 5% of their total workforce from this group, ensuring that roles are suited to their capabilities and skills while guaranteeing all rights and benefits stipulated by labor law, free from any form of discrimination.
The circular also outlines several regulatory procedures to facilitate the employment of persons with disabilities, including established mechanisms for nomination and recruitment, and the requirement for employers to maintain dedicated records for these employees. Additionally, entities are required to notify the Ministry of all new hires within one month of their appointment. The Ministry emphasized that its provincial offices will conduct regular inspection campaigns to ensure compliance with these quotas and will take legal action against any non-compliant entities.
